Environmental Compliance Approvals
An Environmental Compliance Approval (ECA) is a permit issued by the Ontario Ministry of the Environment (MECP) that allows a business to operate a site that may impact the environment by releasing contaminants. Types of ECAs include air, noise, waste and sewage. Less complex activities with minor risk may require a simpler registration process through the Environmental Activity and Sector Registry (EASR).
ECAs and EASRs are a requirement to operate for facilities whose activities may impact the environment. ECAs require amendments if equipment or processes are changed that may impact the environment. ECAs also contain several terms and conditions including requirements for management programs, sampling, monitoring and reporting. Failure to apply for or amend and ECA or failure to comply with the terms and conditions of an ECA can result in fines or orders from the MECP.
It is an important part of due diligence when acquiring a business to access the ECA or EASR requirements related to the operations and ensure the appropriate approvals are in place.
